Abstract

na atual sociedade da informação, os dados pessoais são utilizados para as mais diversas finalidades, inclusive para a defesa nacional e a segurança pública. Neste aspecto, reconhece-se a necessidade de que existam normativos específicos para regular este tipo de tratamento de dados para que os direitos individuais não sejam ameaçados. Dessa forma, países que demonstram preocupação com o tema procuram regulamentá-lo, como é o caso de Brasil e Portugal. Enquanto o Brasil ainda debate o assunto por meio do anteprojeto conhecido como LGPD Penal, em Portugal já existe a Lei n.o 59/2019, que transpõe a Diretiva (UE) 2016/680. O presente artigo analisa as disposições trazidas na norma portuguesa e no projeto de lei brasileiro a fim de identificar as similaridades e diferenças. É possível notar a inspiração do projeto brasileiro na legislação europeia, incorporando em seu texto disposições bastante semelhantes às disposições vigentes em Portugal, especificando de forma clara a possibilidade de compartilhamento de dados entre autoridades de países terceiros e em cooperação internacional.
