UM ESTUDO SOBRE OS REFLEXOS DA PANDEMIA NO PACTO FEDERATIVO BRASILEIRO
Abstract
A presente pesquisa procura entender como a Pandemia do Coronavírus afetou o Pacto Federativo no Brasil. Para tanto, foram levantados todos os decretos editados pelos Estados e Distrito Federal no período de fevereiro a junho de 2020, que estivessem relacionados ao enfrentamento da Pandemia. Para atingir tal levantamento, a metodologia aplicada foi o estudo de caso e foram utilizadas as páginas oficiais e redes sociais dos Governos Estaduais e do Distrito Federal para mapear os normativos. Nesse âmbito, foram analisados 726 (setecentos e vinte e seis) decretos. Após o seu levantamento, esses atos normativos foram categorizados a partir das matérias que tratam e comparados com as disposições referentes a repartição de competências prevista na Constituição. Encontram-se indícios de que não houve coordenação entre os entes federados e nem a elaboração de um plano nacional de enfrentamento à doença por parte da União. Infere-se, então, que houve abalo no Pacto Federativo e estimam-se possíveis efeitos quanto à segurança jurídica.
