BREVES CONSIDERAÇÕES À LEI GERAL DE PROTEÇÃO DE DADOS (LGPD) E SUA CONSONÂNCIA COM O DIREITO FUNDAMENTAL À SAÚDE EM TEMPOS DA PANDEMIA DO NOVO CORONAVÍRUS.
Abstract
O presente artigo acadêmico apresenta um estudo sobre a nova Lei Geral de Proteção de Dados (Lei no 13.709/2018 – LGPD). O objetivo é traçar um alinhamento entre o direito de proteção de dados pessoais, afinado à inviolabilidade da privacidade, e os direitos de proteção da vida e da saúde pública considerando o contexto atual da pandemia causada pelo Coronavírus/COVID-19. As considerações deste trabalho levam em conta o movimento global de estruturação de mecanismos tecnológicos de controle e combate à disseminação da doença. A reflexão converte- se, ao final, no reconhecimento de que o efetivo cumprimento da nova legislação protetiva de dados pessoais, em tempos de pandemia, contribui significativamente com o aperfeiçoamento contínuo de preservação dos direitos fundamentais inerentes à privacidade dos indivíduos.
