O Juiz Criminal: Utopia, Distopia e Prova Ilícita
Abstract
O presente artigo aborda a discussão acerca do objetivo do processo penal e sua interface com a idéia de verdade, enfrentando o tratamento das provas ilícitas, tendo por metáfora condutora da narrativa a idéia de distopia. A hipótese é que a verdade processual penal é sempre uma verdade aproximada, uma perversão da realidade e, portanto, uma verdade distorcida. Ela representa uma realidade quase paralela, que se aproxima do conceito de distopia produzido pela literatura e pela sétima arte.
