PLATAFORMAS MULTILATERAIS E A NOVA ABORDAGEM ANTITRUSTE: COMO O CADE PODE SE REINVENTAR À LUZ DA SUA PRÓPRIA JURISPRUDÊNCIA?
Abstract
O presente artigo versa sobre as recentes doutrinas sobre plataformas multilaterais e como os novos entendimentos podem aprimorar a análise antitruste do CADE. Para isso, apresentará a estrutura e o funcionamento desse tipo de plataforma, estabelecendo os requisitos para definição e diferenciação do mercado de plataforma multilaterais. Ainda, abordará as especificidades da análise concorrencial nesse mercado, bem como os métodos, conceitos e testes sugeridos pela nova abordagem doutrinária para operacionalizar a análise antitruste nesse tipo de mercado, comparando com a jurisprudência do CADE, onde se mostrará de que forma a autarquia pode refinar a sua análise envolvendo plataformas multilaterais.
