HABEAS CORPUS COLETIVO COMO INSTRUMENTO DE IGUALDADE E DE ACESSO À JUSTIÇA: O CASO DO TRÁFICO PRIVILEGIADO DE DROGAS
Abstract
Inicialmente, contextualizou-se a situação do sistema carcerário nacional, apresentando-se a sua evolução ao longo das últimas 3 (três) décadas. Comparou-se o índice de crescimento da população carcerária geral com o de indivíduos em situação de constrangimento de liberdade por tráfico de drogas. Buscou-se entender o motivo do aumento relativo de presos por tráfico de drogas nos presídios nacionais e a influência da Lei de Crimes Hediondos nesse aumento. Ademais, procurou-se compreender os requisitos para a classificação de uma conduta como tráfico privilegiado de entorpecentes e drogas afins. Fez-se um apanhado sobre as principais teses dos tribunais superiores no tocante à necessidade de fundamentação idônea para a imposição de regime mais severo de cumprimento de pena e a vedação de utilização de fundamentações abstratas. Finalmente, ressaltou-se a importância da utilização do habeas corpus coletivo como instrumento de igualdade e de acesso à justiça.
