JUDICIAL ACTIVISM IN THE CONCRETIZATION OF FUNDAMENTAL RIGHTS
Abstract
The article analyzes the characteristics of judicial activism, tracing the origins of the expression itself. It exposes and analyzes the critical appraisals of the phenomenon. It points out the proximity of the practice of activism with the current doctrine of fundamental rights, especially with regard to the aspect of its realization and the role of the judiciary in this effort.
