JUDICIAL ACTIVISM IN THE CONCRETIZATION OF FUNDAMENTAL RIGHTS

Abstract

The article analyzes the characteristics of judicial activism, tracing the origins of the expression itself. It exposes and analyzes the critical appraisals of the phenomenon. It points out the proximity of the practice of activism with the current doctrine of fundamental rights, especially with regard to the aspect of its realization and the role of the judiciary in this effort.

Paulo Gustavo Gonet Branco, IDP

Doutor em Direito, Estado e Constituição pela Universidade de Brasília (2008), Mestrado em Direitos Humanos - University of Essex (1990) e Graduação em Direito pela Universidade de Brasília (1982). Atualmente é Subprocurador-Geral da República (Ministério Público Federal), Professor do Corpo Permanente do Programa de Pós-Graduação Stricto Sensu (Mestrado e Doutorado Acadêmico em Direito Constitucional); e do curso de Graduação em Direito do Instituto Brasiliense de Direito Público - IDP. Professor da Escola Superior do Ministério Público do DF e Territórios. Tem experiência na área de Direito, com ênfase em Direito Constitucional, atuando principalmente nos seguintes temas: direitos fundamentais, jurisprudência do STF, controle de constitucionalidade, inconstitucionalidade lei efeitos e problemas constitucionais em geral
