SUSSIDIARIETÀ E MERCATO NELLE PRESTAZIONI DI ASSISTENZA SOCIALE IN ITALIA
Abstract
Il presente contributo riflette sulla necessita di operare un bilanciamento tra i canoni di sussidiarietà e di tutela della concorrenza per il mercato, nell'individuazione dei criteri di legittimità delle scelte amministrative in merito all'interazione pubblico — privato per l'organizzazione e l'erogazione dei servizi sociali. Si tratta di una ricaduta al livello funzionale della centralità che l'ordinamento giuridico assegna al giorno d'oggi alla tutela della persona nella sua complessità.
This contribution reflects on the need to make a balance between subsidiary and market competition, in identifying legitimacy criteria for administrative decisions about public- private partnership concerning organization and provision of social services. This aspects appears as a functional relapse of person centrality, that legal system recognizes nowadays.
