The EVOLUTION OF DEATH RESULTING FROM POLICE INTERVENTION IN THE BRAZILIAN STATE
An analysis from the decision of the Inter-American Court of Human Rights on the case of Favela Nova Brasília
Abstract
Motivated by the conviction of Brazil in the Favela Nova Brasília case by the Inter-American Court of Human Rights, the present study aimed to evaluate the evolution of deaths resulting from police intervention in the state of Rio de Janeiro, based on the structuring and analysis of a set of data made available by the Rio de Janeiro Public Security Institute, for the period between 2013 and 2020. The analysis showed a picture of massive and persistent violation of fundamental rights in the communities and favelas of Rio de Janeiro, resulting from structural failures of the state Executive Power, the culture of the police and public security agents, characterizing an authentic unconstitutional state of things. It was found that the data made available by the Public Security Institute of Rio de Janeiro state are of low quality, a fact that makes it impossible to accurately identify the municipalities with the highest mortality rate in relation to underage victims. It was also observed that the higher the fatality rate of police interventions recorded in a given municipality, the lower the quality of the data available for analysis. The incompleteness of the information provided by the Institute also compromises the development of public policies capable of reducing the lethality of police operations in the state.
