The ADMINISTRATIVE LAW OF FEAR AND THE IMPACTS ON PUBLIC POLICIES
Abstract
The performance of public administration has become increasingly necessary and complex with the advent of the state providing public services, with public administration being one of the main implementers of public policies. Parallel to the increase in the performance of public administration, the mechanisms of control of administrative acts also increased, in order to reduce illegalities. The actions of controllers generate positive effects for the fight against corruption, however, it does not completely prevent it. In addition, there is a negative aspect, not always observed, resulting from the actions of Organs controlling bodies, namely: administrative fear. Public administrators sometimes start to act with fear, resulting in self-protection postures, with a management without creativity or innovation, immersed in bureaucracy, delays and lack of decisions. This fear policy generates effects on the administrator, including on the performance of public policies, fundamental for the constitutionally foreseen rights.
