DIFERENÇAS BENÉFICAS NO DIREITO MATERIAL TRABALHISTA DOS EMPREGADOS PORTUÁRIOS EM RELAÇÃO AOS EMPREGADOS REGIDOS EXCLUSIVAMENTE PELA CONSOLIDAÇÃO DAS LEIS DO TRABALHO
Abstract
The present article aims to discuss beneficial differences in material labor law of port employees in relation to employees governed exclusively by the CLT, highlighting the night hours of 19 (nineteen) hours of one day to 07 (seven) hours of the next day, the remuneration of the risks of port activity in the percentage of 40% (forty percent), and overtime at 100% (one hundred percent) in services performed during meal times. We tried to show these differences objectively, and without focusing on privileged treatment of port employees with a link to the Port Administration, since the Federal Constitution recognizes the value of work, and, as is widely known, the work in the ports of Brazil has its national and international recognized value. At the end, it was highlighted that the legislator should propose a new general labor norm, in order to assure to all workers under the labor law equivalent conditions in the work relationship.
