CRÍTICAS TEÓRICAS AO TIPO PENAL DE "PERSEGUIÇÃO"
Abstract
In this article there is a criticism of the newly created criminal type of Stalking, through Law N. 14.132, of 2021, which amended the Brazilian Penal Code, with the inclusion of the article 147-A. The terminology adopted is criticized, the absence of a list that delimits the means of externalization of the crime, the abolition of the criminal misdemeanor of disturbance of tranquility and the impunity generated as a result of penalties that go beyond mild when compared to the seriousness of the crime.
