OS DIREITOS DA PERSONALIDADE E COMISSÕES PARLAMENTARES DE INQUÉRITO
Considerações acerca da possível violação do direito à imagem dos cidadãos mencionados no inquérito parlamentar
Abstract
The present article aims to expose reflections fostered from a critical look as to the fine line between the right to information and the unrestricted, immoderate and instantaneous disclosure of the image of non-public persons who are cited during the investigative work developed in the Parliamentary Commissions of Inquiry, installed in the houses of the National Congress. During the investigation, individuals who do not hold relevant public positions, after having their names mentioned in the inquiry, have their images prematurely associated with severe possibly unethical acts, with the mass disclosure, through the major communication vehicles, of their faces. Sometimes, the aforementioned disclosure borders on disproportionality, having as its only justification the mention of the names of the people in a parliamentary investigation that, it should be noted, is in its initial phase of investigation of the fact. It concludes by the maximum observance of the Protection of the Dignity of the Human Person, and maximum caution must be exercised when disclosing the image.
