AUTONOMIA FEDERATIVA ARRANHADA? A SUBMISSÃO DO LEGISLADOR E DA ADMINISTRAÇÃO SUBNACIONAIS À UNIÃO EM ALGUNS ESTADOS FEDERAIS

A autonomia legislativa e administrativa das unidades subnacionais é considerada um elemento central de definição de um estado federal. Diversos estados que se autoproclamam federais possuem, no entanto, instrumentos federais de controle e tutela de competências legislativas e administrativas das unidades subnacionais. A sua existência não é capaz, no entanto, de infirmar-lhes o caráter federal. Outros elementos federativos podem superar os enxertos unitários nesses estados. A sua efetiva natureza federativa, no entanto, ainda depende do exame de como, na prática, articulam-se os diferentes níveis de governo e o efetivo grau de autonomia que possuem e exercem. A estabilidade institucional e democrática contribui decisivamente para o seu sucesso ou fracasso, pelo menos, nos casos estudados neste artigo.
