THE ENERGY TRANSITION IN THE SPANISH CONSTITUTIONAL CONTEXT

Abstract

This paper examines Spain's Law 7/2021, of May 20, on Climate Change and Energy Transition. The law establishes an essential regulatory framework to meet emission reduction targets and promote renewable energies. Although the 1978 Constitution does not explicitly mention the competence to legislate on climate change and energy transition, these areas fall within the State's powers to protect the environment and plan the economy. Law 7/2021 is developed under these exclusive state powers, allowing the Autonomous Communities to create complementary regulations tailored to their regional needs. The regional legislations of the Valencian Community, the Basque Country, the Canary Islands, and the Foral Community of Navarre, the first to develop the state regulations, are also examined.
