Abstract

In this article we analyze the dynamics of the internal change of legal ideas in the judicial powers. From the analysis of the transformation in terms of human rights ideas that took place in the Mexican Federal Judicial Power between 2009 and 2018, we observe the importance of the dynamics of internal change to understand how this innovation was institutionalized. We propose an analytical framework that complements others, focused on the region, that emphasize external drivers of change or the importance of individual judicial leadership. The constructed analytical framework takes into account time – a key dimension in the study of changes –, and integrates two perspectives that problematize it and that are used by other research on judicial powers: a) diffusion theory, which models change as communicative process, and b) the approximation to the institutional dynamics developed by the historical neo-institutionalism that problematizes the change from the distribution of power. The main finding derived from our analysis, when incorporating the novelties provided by the Mexican case, is the following: it is necessary to integrate the interrelation between the communication of new ideas and the distribution of knowledge into the study of the institutionalization of changes in the judiciary. internal power. The Mexican case forces us to consider this interrelation if we want to more effectively describe the evolution and dynamics of the changes within the judicial powers in Latin America.
