Abstract

The proportionality test has been widely adopted in the context of contemporary constitutionalism as a methodological criterion to verify the justification of state measures that affect the scope of protection of fundamental rights. An analysis of some decisions proves that the Supreme Federal Court is still far from applying the proportionality test according to its widely accepted standard structure. This has authorized criticism of the correctness of the justification of the decisions, notably directed at subjectivity and arbitrariness. The proposed discussion aims to show that the proportionality test leads rather to objectivity and rational control of judicial decisions than subjectivity and irrationality. The union between proportionality and rational argumentation necessarily implies correctness and legal security. The approach method is analytical and the technique of bibliographical research
