Abstract

The current study seeks to analyze how the concept of woman is applied to the criminal justice system, especially from the Femicide Law which, founded on a biological matrix (female gender), brings up the following question: Does the hermeneutics of femicide allow a large interpretation, including transsexual women and transvestites within the scope of protection of the norm? A decolonial feminist methodology was used, based on a bibliographical study in dialogue with transfeminisms, to outline the contours of concepts of woman, gender and trans identity. Supported by the decolonial view, through the analysis of two judgments of the Superior Court of Justice, the perception of the justice system on the subject was revealed. It was concluded that it is necessary to break with the cisgender nature of the justice system, which condones colonial, racist, cis-sexist practices, which does not bring a gender perspective to the debate and reaffirms the androcentric and patriarchal inclination of Law. By decolonizing femicide, giving an extensive interpretation to the woman category, we guarantee the application of the Law to transsexual and transvestite women.
