Discriminação Algorítmica no Brasil: Uma Análise da Pesquisa Jurídica e suas Perspectivas para a Compreensão do Fenômeno

Abstract

This article aims to analyze the approach of academic research on algorithmic discrimination in the field of Law in Brazil, providing a description of the current stage of this discussion. Based on a scope review of legal literature, the areas of Human Rights and Administrative Law were identified as having the main concentrations of studies on the subject. The research was conducted through a systematic search in journals indexed in Scopus, Web of Science (WoS), SciELO, and Google Scholar (GS), as well as publications from the International Congress on Law and Artificial Intelligence (CIDIA). The initial hypothesis that research on algorithmic discrimination in Law in Brazil is in an early stage was confirmed, but with the identification of strong growth potential. The conclusions also indicated that the field of Law shows a concentration of studies on similar discriminatory cases, as well as the identification of similar objects of analysis and issues. On the other hand, sub-areas of Law such as civil law, labor law, and criminal procedural law lack further investigation. The research and its conclusions are justified considering the importance of interdisciplinary approaches in order to obtain a comprehensive and up-to-date understanding of the phenomenon of algorithmic discrimination, enabling the development of more efficient regulatory solutions for new technologies.
