Abstract

The article analyzes the role of the Brazilian black movement in process of formation and transformation tof he 1988 Constitution, starting from its drafting by the National Constituent Assembly, through its implementation in political and legal spheres. The discussion surrounding affirmative actions is employed to illustrate that since 1986, the black movement has been articulating a demand for the constitutionalization of specific rights in defense of black individuals, either formally through their inclusion in the constitutional text or through infra-constitutional or interpretative means. To understand this engagement, the concept of struggle for the constitution is applied, understood as the process by which social groups seek, in different spaces, to crystallize their belonging to the constitutional community and to enshrine their claims as fundamental rights. In conclusion, it is asserted that the black movement's engagement since the 1980s has allowed it to deploy a series of strategies enabling the realization of various forms of struggles for the 1988 Constitution on the streets, in institutional politics, and before judicial instances.
