Legal Aspects of Electricity Export in the Context of Regional Integration

A Comparative Study between the European Union and Mercosur

Abstract

The export of electricity in regional integration contexts faces different legal challenges between the European Union (EU) and Mercosur, due to the distinct regulatory approaches of each bloc. The EU benefits from a harmonized and advanced regulatory framework, such as the Third Energy Package and the Clean Energy Package, which facilitates electricity trade among Member States. Additionally, the presence of a supranational regulatory authority, like the Agency for the Cooperation of Energy Regulators (ACER), ensures legal certainty, predictability, and efficient dispute resolution mechanisms. In contrast, Mercosur, although economically integrated, operates primarily through bilateral agreements, such as the Itaipu Treaty and the Garabi interconnection, without a regional regulatory body to coordinate energy policies in an integrated manner. This absence of a common framework results in legal uncertainties, especially during energy crises or commercial disputes. The comparative study between the two blocs aims to identify successful practices from the EU and suggest ways for Mercosur to advance in harmonizing its regulatory and legal frameworks, aiming to improve regional energy integration and enhance legal certainty and efficiency in electricity trade among its member countries.

Lawyer and Geographer. He holds a Postdoctoral degree in Law from the Federal University of Minas Gerais (UFMG, Brazil) and a Ph.D. in Geography from the University of Brasília (UnB, Brazil). He is currently a Ph.D. candidate in Law at the University of Coimbra (FDUC, Portugal). He is a researcher at the Paulista Center for Energy Transition Studies (CPTEn) at UNICAMP, Brazil (CPTEn and FAPESP 2024/04170-2). Previously, he was a researcher at the Research Center for Justice and Governance (JusGov) at the School of Law of the University of Minho (Portugal); at the Chaire Normandie pour la Paix at Université Caen Normandie (France); a Senior Collaborating Professor in the Graduate Program in Geography at the University of Brasília (UnB); and a Professor of Energy Law at Universidade Candido Mendes (UCAM/RJ, Brazil).

David Felice Falivene Baptista, II Faculdade de Engenharia Elétrica e de Computação da Universidade Estadual de Campinas. (FEEC-UNICAMP).

He holds a Ph.D. (2024) from the School of Electrical and Computer Engineering at the University of Campinas (FEEC-UNICAMP), with a research exchange period at the Law School of the University of Minho (Braga/Portugal), focusing on Energy Law and Legal Regulation. He holds a Bachelor's degree in Electrical Engineering (2015) and in Law (2022). He obtained a Master’s degree (2019) from FEEC-UNICAMP, working on Artificial Intelligence and Telecommunications. He is a member of the Institute for Advanced Studies at UNICAMP, conducting research in the field of Ethics and Legal Regulation of Artificial Intelligence. He is a researcher at the Paulista Center for Energy Transition Studies (CPTEn - CCD FAPESP) and the MERGE Research and Development Project (ANEEL/CPFL Energia), with a focus on Energy Regulation, Energy Transition, and Sustainability.

Member of the Academic Advisory Board for the Global Center for Legal Innovation on Food Environments at the O'Neill Institute for National and Global Health Law. He is a Professor of Public International Law and Environmental Law at the Faculty of Law of PUC-Campinas and a Professor of Human Rights Education: History, Culture, and Environment at the Faculty of Philosophy of PUC-Campinas.
