Dialogue between TWAIL and Descolonial Thinking

Abstract

The conditions of social vulnerability and subalternization generated by colonialism and imperialism, perpetuated in contemporary times by coloniality and imperiality, allowing International Law to be not only unequal, but also a hierarchical right. Motivated by studies referring to decolonial theories and Third World Approaches to International Law (TWAIL), the present research seeks to verify the contributions of the dialogue between these theoretical currents so that International Law can break with its hierarchical structure, that is, it seeks to verify if a Decolonial International Law is possible. The present work is built from a hypothetical-deductive approach. With regard to the analysis of objectives, this was achieved in an exploratory, descriptive and critical way, since a bibliographic survey was carried out, describing the proposed alternative, which was conjectured from the theoretical frameworks adopted. Bibliographic and documentary tools were used as procedures.
