Uma breve análise das contribuições teóricas de C. S. Nino e O. M. Fiss.

Abstract

This article has three specific objectives. First, to explain the context, climate and intellectual accompaniment of the Democratic Government of the Argentine Transition from 1983 to 1989. Secondly, to reconstruct synthetically and precisely, the theorizations made on the terms constitutional democracy and human rights by the political philosophers C. S. Nino and O. M. Fiss. Third, to explain the influence of this context on these theorizations, giving an account of: a) the approach made by C. S. Nino to a non-ideal normative theory and to a broad liberalism with notorious republican elements; and b) O. M. Fiss's passage from his concept of human rights to mere positive legal standards for that of social ideals, as well as the mitigation of his objections to the Critical School of Law and its correlative approach to a certain civic republicanism.
