Abstract

This article aims to analyze the implementation of Law n. 12,711/2012, which deals with the Affirmative Action Policy, with regard to its applicability, obstacles and limits. This is a qualitative bibliographical research based on studies by Minayo (2008) supported by the Critical Theory of Race (CRT) and by the theoretical framework of black intellectuals who study racial issues. The chosen method for data analysis articulates hermeneutics and dialectics, which allowed us both to interpret the meanings of the elaborated discourses (hermeneutics) and to understand their meanings, through contradiction, of the historical and social context in which they were constituted (dialectics). The results point to a certain institutional resistance to the adoption of affirmative actions within the scope of educational public policies, while they are unaware of and/or resist understanding the historical and social processes that preceded their creation, as well as measuring their importance for the education of the black population, Brazilian society and the University itself. The data also reveal signs of incipient administrative controls. The Policy's social controls indicate a low approximation between the Institution and the community in which it is inserted, above all, with the Brazilian Black Movement.
