Abstract

This article analyzes the contentious performance of company workers' unions under the model of digital platforms within the scope of the Labor Court. The discussion begins with a survey and mapping of platform workers' unions across the country, as well as the collective lawsuits filed by these unions in all twenty-four Regional Labor Courts. The conclusion indicates that the access to justice of these unions presupposes the existence of union registration, given that all collective actions filed did not contain a union “letter”, which was the reason for the extinction of the action without resolution of the merits due to the active illegitimacy in some cases. As for the methodology, the qualitative method and the documentary research technique were chosen due to the collection of data in the judicial processes.
