Abstract

The article focuses on how the Supreme Federal Court addresses constitutional facts in structural processes. Luiz Guilherme Marinoni’s criticism regarding the lack of adversarial proceedings and effective participation becomes even more serious in structural processes, as these require the participation of the involved groups both for instrumental reasons and for the very legitimacy of judicial intervention. The study advocates for the need to return the Constitution to the people, ensuring that those involved can take part in constitutional interpretation and, consequently, in decision-making. Finally, proposals are presented to improve the conduct and development of structural processes before the Supreme Federal Court, aiming to make the participation of vulnerable groups more effective in these types of cases.
