Abstract

This article aims to study structural processes within the scope of the Federal Supreme Court, also exploring the recent Bill nº 3/2025, which aims to discipline this complex procedural instrument. With the institutional rise of these processes in the Supreme Court, the question in this research is how to ensure the legitimacy and efficiency of the structural interventions of this Court, and whether the rules of the aforementioned project can contribute to this purpose. The objectives are to present parameters of legitimacy and efficiency of structural processes, verify how these can be observed by the Federal Supreme Court and evaluate the possible contribution of some of the provisions of the law that may result from Project nº 3/2025. The idea is to examine these parameters and requirements in parallel to the regulation intended in the bill. The methodology used was the bibliographic review. The conclusion is that the Project covers the essential requirements to ensure the legitimacy and efficiency of structural judicial intervention and that, therefore, its rules can contribute to a better structural jurisdiction of the Federal Supreme Court.
