Abstract

This article deals with the institute of emphyteusis, which consisted of granting useful ownership of land to individuals, as long as pre-established conditions were met, considering that the territory of the Vilas was under royal domain, administered by the Senate of the Chamber. Thus, the objective is to better understand tenure, from a legal perspective, based on deeds and terms drawn up by clerks in the 18th century, in the village of Santa Cruz do Aracati, in the Captaincy of Ceará, due to its rapid expansion and allocation of land for salted meat workshops and cattle breeding. Methodologically, notarial books are analyzed, in which there are 14 deeds, to understand how the emphyteusis happened in practice and which legal institutes are related to it, starting from a local perspective. Furthermore, the Philippine Ordinances and books of doctrine were also used to understand the legal treatment of the period. As a result, concepts such as emphyteusis, laudêmio, right of prelation, useful domain, direct lordship, condition of tenure and chapel bond present in the deeds were identified, in addition to the possibility of tax exemption from chartering and sale of foreign land. It is concluded that emphyteusis was another mechanism to be used by agents of the Crown, due to their power over the land and its formalized use, guaranteeing the realization of their interests and monetary collection for the Royal Treasury.

Joana Aymée Nogueira de Freitas is a Master's student in Law at the Federal University of Ceará, with a CAPES scholarship. She participated in the Summer Academy for Legal History at the Max-Planck Institute for Legal History and Theory (2023). She graduated in Law from the Federal University of Ceará with magna cum laude (2022). She is a member of the research group "History of Law: the paths of the formation of Brazilian law". She is a member of the extension group "Núcleo de Estudos em Direito na América Portuguesa (NEDAP)", in which she was an extension fellow (2020).

Gustavo César Machado Cabral, Professor at the Faculty of Law of the Federal University of Ceará (UFC), working in Undergraduate and Postgraduate Studies (Masters and Doctorate).
